SHIPPING, DELIVERY, CANCELLATIONS, RETURNS & DAMAGE POLICY

Thank you for choosing BA Studio USA. Our furniture is produced with care and many of our pieces are made or prepared specifically after an order is placed. Due to the nature, size, weight, and production process of furniture, special shipping, cancellation, return, and damage-claim conditions apply.
By placing an order through our website, the customer acknowledges and agrees to the following terms.
1. Estimated Production Times
Production times displayed on our website are estimates only and are not guaranteed completion dates.
Because our furniture is produced and prepared according to incoming orders, actual production times may vary depending on order volume, material availability, production capacity, seasonal demand, holidays, quality-control requirements, circumstances beyond our reasonable control, and other factors affecting manufacturing.
An estimated production period begins only after an order has been successfully placed, payment has been confirmed, and all information necessary to process the order has been received.
Production time does not include transportation or delivery time.
BA Studio USA makes reasonable efforts to complete orders within the estimated production period shown at the time of purchase; however, an estimated production time should not be interpreted as a guaranteed shipment or delivery date.
2. Estimated Shipping and Delivery Times
All shipping, transit, and delivery dates provided by BA Studio USA, its website, customer service representatives, or third-party carriers are estimates unless expressly stated otherwise in writing.
Estimated delivery dates may vary due to factors including, but not limited to:

Production workload;

Carrier availability;
-
Freight network conditions;
-
Weather;
-
Holidays;
-
Delivery-area restrictions;
-
Appointment availability;
-
Transportation delays;
-
Mechanical issues;
-
Natural disasters;
-
Government actions;
-
Road closures;
-
Labor disruptions; or
-
Other circumstances beyond BA Studio USA's reasonable control.
Once an order has been transferred to the carrier, transportation and final delivery are subject to the carrier's operations and scheduling.
BA Studio USA does not guarantee an exact delivery date or delivery time solely on the basis of an estimate displayed on the website or provided by a carrier.
If BA Studio USA becomes unable to ship an order within an applicable shipment timeframe, BA Studio USA will handle the delay and any cancellation or refund rights in accordance with applicable law.
3. Shipping Availability
BA Studio USA ships only to destinations made available through the official BA Studio USA website at the time the order is placed.
The availability of checkout or shipping service to a particular state, ZIP Code, city, or territory determines whether BA Studio USA currently offers delivery to that destination.
BA Studio USA is not obligated to ship an order to any location that was not eligible for shipping through the website when the order was placed.
Shipping availability may change at any time.
4. Shipping Address — Customer Responsibility
The customer is solely responsible for entering a complete, accurate, and deliverable shipping address at checkout.
The shipping address submitted with the order should be considered final.
BA Studio USA does not guarantee that a shipping address can be changed after an order has been submitted.
This policy is particularly important because freight rates, carrier availability, delivery methods, taxes, and service availability may vary substantially depending on the destination.
For example, an order originally placed for delivery in Texas cannot subsequently be treated as an order placed for delivery in another state or territory where different freight rates or delivery restrictions apply.
If a customer requests an address change, BA Studio USA may review the request at its sole discretion, provided the order has not already progressed too far through production, processing, or shipment.
Approval is not guaranteed.
If an address change is approved, the customer will be responsible for any additional freight charges, carrier fees, rerouting fees, storage charges, taxes, or other expenses resulting from the requested change.
Once an order has shipped, BA Studio USA is not required to reroute it.
BA Studio USA is not responsible for delays, failed deliveries, additional fees, losses, or other consequences resulting from an incorrect or incomplete address supplied by the customer.
5. Standard Furniture Delivery
Unless a different service is expressly purchased or confirmed in writing, BA Studio USA furniture is shipped using Standard Furniture Delivery.
Standard Furniture Delivery generally means delivery to the first accessible delivery point at the shipping address, such as:

The exterior/front door of a residence;

Building entrance;
-
Lobby;
-
Reception area;
-
Garage or other carrier-approved accessible location; or
-
Another comparable ground-level delivery point designated by the carrier.
Standard Furniture Delivery does not include room-of-choice placement, stair carry, elevator carry, interior placement, furniture rearrangement, installation, unpacking, assembly, debris removal, packaging removal, or disposal services.
The exact location at which the carrier is able to safely complete delivery may depend on property access, building rules, local conditions, carrier policies, and driver discretion.
6. Optional or Enhanced Delivery Services
In certain areas, BA Studio USA or its transportation partners may offer additional delivery services, including threshold delivery, inside delivery, room-of-choice delivery, or similar upgraded services.
Such services are included only when they are specifically identified in the customer's order or otherwise confirmed in writing.
If a carrier voluntarily provides additional assistance beyond the service purchased, such assistance is provided at the carrier's discretion and does not create an obligation for BA Studio USA to provide the same service on future deliveries.
Unless expressly included in the purchased service, BA Studio USA is not responsible for:

Moving the furniture into a particular room;

Repositioning existing furniture;
-
Assembly;
-
Installation;
-
Removal of packaging;
-
Removal of pallets;
-
Removal of cardboard;
-
Removal of protective materials; or
-
Disposal of any shipping-related materials.
7. Heavy and Fully Assembled Furniture
Many BA Studio USA products are manufactured as substantial, heavy-duty pieces and may be delivered fully or substantially assembled.
Customers should assume that large furniture may be heavy and difficult for one person to move safely.
Depending on the item, two or more capable adults may be required to move the furniture from the delivery location into the customer's home and to position it safely.
The customer is responsible for arranging adequate assistance for moving the furniture after the carrier completes the contracted delivery service.
BA Studio USA is not responsible for injuries, property damage, floor damage, wall damage, door damage, or damage to the furniture resulting from improper lifting, dragging, handling, installation, or movement after delivery.
Customers should never attempt to move a heavy furniture item without sufficient assistance.
8. Access, Doorways, Elevators and Measurements
Before ordering, the customer is responsible for confirming that the furniture will fit through all necessary access points, including:

Exterior doors;
-
Interior doors;
-
Hallways;
-
Stairways;
-
Elevators;
-
Building entrances;
-
Gates; and
-
Other applicable access areas.
Customers should review both product dimensions and the dimensions of the delivery path before purchasing.
BA Studio USA is not responsible if a product cannot enter the customer's residence or intended room because of access limitations.
A customer's failure to measure the delivery area does not constitute a product defect or shipping damage.
If a delivery cannot be completed because the furniture does not fit, access is unavailable, building restrictions prevent delivery, or the customer cannot accept the item, additional freight, storage, return, redelivery, and restocking charges may apply.
9. Tracking Information and Delivery Coordination
When available, BA Studio USA will provide the customer with shipment or tracking information after the order has been transferred to the carrier.
Depending on the type of shipment, the carrier may also contact the customer directly to coordinate delivery.
Tracking information and carrier notifications are provided so that customers can reasonably prepare for receipt of their furniture.
It is the customer's responsibility to monitor tracking information, respond to carrier communications, and make appropriate arrangements to receive the shipment.
An estimated delivery day displayed by a carrier remains subject to change.
10. Failed Delivery and Redelivery Charges
If a carrier is unable to complete delivery due to circumstances attributable to the customer, additional charges may apply.
Examples include:

No authorized person being available when required;
-
Failure to respond to delivery scheduling requests;
-
Failure to provide reasonable access;
-
Incorrect address information;
-
Building restrictions not previously disclosed;
-
Refusal of an undamaged shipment;
-
Inability to complete delivery because the product does not fit; or
-
Failure to otherwise comply with carrier delivery requirements.
The customer will be responsible for applicable redelivery, storage, handling, rerouting, return freight, or other carrier charges resulting from such circumstances.
BA Studio USA may require payment of these charges before another delivery attempt is scheduled.
11. Order Changes — Colors, Sizes and Specifications
Customers are responsible for carefully selecting all product options before placing an order, including color, wood finish, fabric, size, configuration, quantity, and other available specifications.
Customers are strongly encouraged to review their selections carefully and include any necessary information in the order notes at checkout.
BA Studio USA is not obligated to modify an order after it has been placed.
However, customers may request a modification within the first three (3) business days following the order date.
BA Studio USA will make reasonable efforts to accommodate a requested change when production status allows, but approval is not guaranteed.
A requested change becomes valid only after BA Studio USA confirms the modification.
Sending an email, message, or request does not by itself mean the modification has been accepted.
After the three-business-day modification period has expired, production may already be underway and changes to color, size, configuration, finish, or other specifications may no longer be possible.
Any approved modification may also affect the estimated production time, price, or delivery schedule.
12. Order Cancellation — First Three Business Days
Because BA Studio USA processes orders for production shortly after purchase, cancellation requests must be made promptly.
An order may be cancelled without a BA Studio USA cancellation fee if the cancellation request is received within three (3) business days from the date the order was placed, provided no special circumstances make the order non-cancellable.
Cancellation requests must be submitted through BA Studio USA's official customer-service contact method.
A cancellation is not considered complete until it has been confirmed by BA Studio USA.
13. Order Cancellation — Days 4 Through 10
If a customer requests cancellation after the initial three-business-day cancellation period but no later than ten (10) calendar days after the order date, BA Studio USA may approve the cancellation subject to a 40% production cancellation fee calculated on the merchandise amount being cancelled.
The remaining eligible balance will be refunded to the original payment method.
This fee reflects costs that may already have been incurred in connection with the order, including materials, labor allocation, production planning, administrative processing, payment processing, and manufacturing work already initiated specifically for the customer's order.
Shipping charges for services already incurred and other nonrecoverable third-party charges may also be non-refundable where permitted by law.
14. Cancellations After Ten Days
After ten (10) calendar days from the order date, orders are considered committed to production and ordinarily cannot be cancelled.
BA Studio USA reserves the right, but has no obligation, to consider exceptional cancellation requests on a case-by-case basis.
Any exception approved by BA Studio USA may be subject to production, administrative, material, freight, payment-processing, or other applicable charges.
Nothing in this cancellation policy eliminates any cancellation or refund right that a customer is entitled to exercise under applicable law, including rights arising when BA Studio USA is unable to ship merchandise within an applicable promised or legally required shipment timeframe.
15. Refused Deliveries
Customers should not refuse delivery solely because they have changed their mind about the purchase, color, size, finish, style, or placement of the furniture.
If an undamaged shipment is refused without prior written authorization from BA Studio USA, the shipment may be treated as an unauthorized return.
The customer may be responsible for:

Original shipping charges;
-
Return freight;
-
Storage charges;
-
Carrier handling charges;
-
Redelivery charges; and
-
Any applicable restocking fee.
Refusing delivery does not automatically cancel an order or entitle the customer to a full refund.
If the shipment appears damaged, customers should follow the damage-inspection procedures described below rather than automatically refusing delivery unless the damage is severe or the carrier or BA Studio USA specifically instructs otherwise.
16. Inspection at Delivery
Customers should inspect the exterior packaging and furniture as soon as reasonably possible upon delivery.
If there is visible damage to the box, crate, pallet, wrapping, or furniture, customers should photograph the condition before moving or opening the shipment.
Where a carrier provides a delivery receipt, visible packaging damage should be noted on the carrier's delivery documentation whenever possible.
Customers should retain all packaging materials until they have fully inspected the furniture and confirmed that no shipping-damage claim will be necessary.
17. Shipping Damage — 48-Hour Reporting Requirement
Any claim involving damage reasonably believed to have occurred during transportation must be reported to BA Studio USA within forty-eight (48) hours of the carrier's recorded delivery.
Claims submitted after this period may be denied where BA Studio USA or the carrier can no longer reasonably verify that the reported damage occurred during transportation.
The customer should not repair, refinish, modify, dispose of, or further damage the product before BA Studio USA has had an opportunity to review the claim.
BA Studio USA may request additional information before determining the appropriate resolution.
18. Unboxing Video Requirement for Shipping-Damage Claims
Because damage can occur while furniture is being unpacked, customers are strongly required to document the initial unboxing of the furniture when making a transportation-damage claim.
For the best possible documentation, the customer should record one continuous unboxing video beginning before the shipping protection or packaging is removed and continuing until the furniture has been fully exposed and visually inspected.
The video should clearly show:

The unopened or originally delivered package;
-
The condition of the exterior packaging;
-
The removal of protective materials;
-
The furniture as it first becomes visible; and
-
The specific area where damage is claimed.
Customers should exercise particular care when using knives, box cutters, scissors, blades, or other sharp objects.
Sharp tools should never be inserted deeply into packaging or used directly against furniture surfaces.
Damage caused during unpacking, including scratches, cuts, punctures, chips, tears, or other damage caused by knives, box cutters, tools, improper lifting, or improper handling, is not considered shipping damage.
For a shipping-damage claim, BA Studio USA may request:

The unboxing video;
-
Photographs of the complete item;
-
Close-up photographs of the damage;
-
Photographs of the exterior packaging;
-
Photographs of interior protective materials;
-
The shipping label;
-
The order number; and
-
Additional information reasonably necessary to investigate the claim.
Failure to provide sufficient evidence may affect BA Studio USA's ability to verify that damage occurred while the furniture was in transit and may result in denial of a shipping-damage claim.
19. Shipping-Damage Resolution
A report of shipping damage does not automatically entitle the customer to a full refund.
After reviewing the evidence, BA Studio USA will determine an appropriate remedy consistent with the circumstances and applicable law.
Depending on the nature and severity of the damage, available remedies may include:

Replacement components;
-
Repair assistance;
-
Professional repair;
-
Partial replacement;
-
Full replacement;
-
An agreed partial refund or credit; or
-
Another reasonable resolution.
BA Studio USA reserves the right to repair or replace a damaged component when doing so reasonably restores the furniture rather than replacing the entire product.
20. Original Packaging
Customers should retain all original packaging until the furniture has been inspected and any potential claim has been resolved.
This includes, when applicable:

Cardboard;
-
Foam;
-
Corner protection;
-
Plastic wrapping;
-
Blankets;
-
Crates;
-
Pallets; and
-
Other protective materials.
A carrier may require packaging photographs or original packaging when investigating a damage claim or return.
Disposing of packaging before a claim is reviewed may limit the ability to process the claim.
21. Natural Wood and Material Variations
BA Studio USA furniture incorporates natural materials, including natural wood and natural wood veneer.
Wood is a natural material and no two pieces are identical.
Normal variations may include differences in:

Grain pattern;
-
Grain direction;
-
Color;
-
Tone;
-
Texture;
-
Mineral streaks;
-
Natural markings;
-
Small knots; and
-
Other characteristics inherent to natural wood.
Digital photographs, studio lighting, room lighting, monitor settings, phone displays, and natural differences between material batches can also affect the appearance of a product.
Reasonable variations in natural grain, color, pattern, or texture are not manufacturing defects and are not considered shipping damage.
Likewise, minor variations between a product and photographs displayed online are expected when natural materials are used.
22. Handmade and Production Variations
Certain BA Studio USA products involve manufacturing processes that may produce minor variations between individual pieces.
Small differences that do not materially affect the function, structural integrity, or intended appearance of the furniture may be considered normal production tolerances rather than defects.
Each claim will be evaluated according to the nature of the product and the condition reported.
23. Damage After Delivery
Once the furniture has been delivered without verified transportation damage, BA Studio USA is not responsible for damage caused by subsequent handling or use, including:

Dragging;
-
Dropping;
-
Improper lifting;
-
Improper installation;
-
Moving the furniture;
-
Use of sharp objects;
-
Cleaning with inappropriate chemicals;
-
Excessive moisture;
-
Heat exposure;
-
Direct sunlight;
-
Impact;
-
Misuse;
-
Unauthorized repairs or alterations; or
-
Failure to follow applicable care instructions.
24. Returns
Eligible non-defective merchandise may be considered for return when the customer submits a return request within seven (7) calendar days after documented delivery.
All returns require prior authorization from BA Studio USA.
Customers must not send merchandise back without receiving return instructions.
To qualify for an approved return, merchandise must be:

Unused;
-
Unmodified;
-
Free from customer-caused damage;
-
In resalable condition;
-
Complete with all components; and
-
Properly protected for return transportation.
BA Studio USA reserves the right to reject a return that does not satisfy these conditions.
Customized products, specially modified products, products expressly designated as Final Sale, and products manufactured with customer-requested specifications outside the standard options offered on the website may not be returnable.
25. 25% Restocking Fee
Approved returns of non-defective merchandise are subject to a 25% restocking fee, calculated on the merchandise amount being returned.
The restocking fee reflects costs associated with receiving, inspecting, handling, processing, repackaging, storing, and remarketing large furniture items.
Original shipping and delivery charges are non-refundable except where otherwise required by applicable law.
The customer is also responsible for return freight and related transportation expenses unless the return results from a verified defect, verified shipping damage, an error by BA Studio USA, or applicable law requires otherwise.
Return freight can be substantial due to the size and weight of furniture.
Any applicable restocking fee, return freight, storage fee, packaging expense, damage deduction, or other authorized charge may be deducted from the customer's refund.
26. Condition of Returned Merchandise
Returned furniture will be inspected after it is received.
BA Studio USA may reduce or deny a refund if merchandise has been used, damaged, modified, improperly packaged, or returned in a condition materially different from the condition in which it was delivered.
Customers are responsible for protecting furniture adequately during return transportation.
Damage occurring because the customer failed to package a return appropriately may be deducted from the refund.
27. Refund Processing
Approved refunds will be issued to the original payment method whenever reasonably possible.
BA Studio USA will process the refund after the merchandise has been received and inspected, except when applicable law requires an earlier refund.
Bank, card issuer, and payment-provider processing times are outside BA Studio USA's control and may affect when the refunded funds appear in the customer's account.
Shipping, freight, delivery upgrades, expedited services, and other services already performed are generally non-refundable.
28. Delays Beyond BA Studio USA's Control
BA Studio USA will make reasonable efforts to fulfill orders efficiently but is not responsible for ordinary delays caused by circumstances outside its reasonable control, including transportation interruptions, severe weather, natural disasters, carrier delays, labor disruptions, material shortages, governmental actions, customs or border conditions, road closures, or other comparable events.
However, nothing in this section eliminates any right to cancellation, notice, or refund that applicable law requires when a shipment cannot be made within an applicable shipment timeframe.
29. Estimated Times Are Not Guarantees
For avoidance of doubt:
Production times, shipment dates, transit times, arrival dates, and delivery appointments displayed or communicated by BA Studio USA are estimates unless BA Studio USA expressly states in writing that a particular date is guaranteed.
Customers should not schedule contractors, installers, movers, travel, events, construction work, property closings, or other time-sensitive commitments based solely on an estimated furniture delivery date.
BA Studio USA is not responsible for consequential expenses incurred because a customer independently relied on an estimated production, shipment, or delivery date, to the extent permitted by applicable law.
30. Customer Acceptance of This Policy
By placing an order through BA Studio USA, the customer acknowledges that they have had an opportunity to review:

Product specifications;

Dimensions;
-
Colors and finishes;
-
Estimated production times;
-
Estimated shipping times;
-
Delivery conditions;
-
Cancellation terms;
-
Return conditions;
-
Restocking fees; and
-
Damage-claim requirements.
Completion of an order constitutes acceptance of this Shipping, Delivery, Cancellations, Returns & Damage Policy, subject to rights that cannot legally be waived under applicable federal, state, or local law.
BA Studio USA reserves the right to update this policy prospectively from time to time. The version applicable to an order will generally be the version in effect when the order was placed, except where a change is required by applicable law.
